Litigation permanently dismissed between RxHeat and ThermaPure

ST. LOUIS — After a lengthy court battle, ThermaPure®’s lawsuit against RxHeat and Cambridge Engineering has been dismissed by the Northern District of Illinois Court, according to a press release.

“Legal issues can be confusing, so we are taking this opportunity to clearly state that professionals in the restoration and pest control markets can operate our Rx12 and Rx15 heaters free of any temperature limitations, as their projects merit," Braun pointed out.

The suit involved a claim by ThermaPure that RxHeat’s gas-fired Rx12 and Rx15 heaters infringed on ThermaPure’s ‘812 patent, the release explained.

“This ruling means that no jury will ever find these products as infringing as long as they are used in the manner intended and prescribed,” Marc Braun, executive vice president for RxHeat and Cambridge Engineering clarified in the release. “While this suit was a long disruption to our business, we were not going to give up this fight until a clear resolution was reached, protecting the interest of our clients. We were elated, but not surprised, that the Court confirmed the non-infringement arguments on the Rx12 and Rx15 products."

Both parties have agreed to permanently end the case, the release continued.

RxHeat offers the “set it and forget it” feature, which allows its units to be set to any specific temperature needed if a project requires higher temperatures.
